By engaging with Martel Visuals’ services or visiting our website, you agree to these Terms of Service. If you do not accept these terms, please refrain from using our services.

1. Services

Martel Visuals provides creative services focused on web design and digital presence, including:

• Website design and development

• Website redesigns

• Visual and brand direction

• UI/UX design for web platforms

• No-code development (including tools such as Framer)

• Photography and videography for web and brand use

2. Client Responsibilities

2.1. Project Information

Clients agree to:

• Provide clear and accurate project requirements and objectives

• Supply necessary content, assets, and access credentials in a timely manner

• Review and approve work within agreed timelines

• Confirm they hold the legal rights to all materials provided

  
  

2.2. Communication & Approvals

Clients agree to:

• Assign a primary point of contact for all communication

• Respond to feedback and approval requests within a reasonable timeframe

• Understand that delays in communication may impact delivery timelines

  
  

3. Our Commitments

3.1. Service Delivery

Martel Visuals commits to:

• Deliver work aligned with the agreed scope, timeline, and quality standards

• Maintain professional and clear communication throughout the project

• Protect client confidential information and data

3.2. Revisions

• A defined number of revisions is included as outlined in the project scope

• Requests beyond the agreed scope may require additional fees or timeline adjustments

  
  

4. Intellectual Property

4.1. Client Content

Clients retain full ownership of all content, logos, and assets they provide.

4.2. Final Deliverables

• Ownership or usage rights of final deliverables transfer upon full payment

• Martel Visuals retains the right to display completed work in portfolios, case studies, and promotional materials unless otherwise agreed in writing

  
  

4.3. Third-Party Materials

• Use of third-party assets (such as fonts, stock imagery, plugins, or platforms) may require separate licenses

• Clients will be informed of any such requirements prior to implementation

5. Payment Terms

5.1. Invoicing

• Payment schedules are defined in each project agreement

• Invoices are due within the timeframe stated in the agreement

• Late payments may result in paused work or additional fees

  
  

5.2. Refunds

• Refunds are not typically offered for services rendered

• In limited cases, partial refunds may be considered based on project stage and circumstances

6. Timelines & Delays

6.1. Estimated Delivery

• Timelines are estimates based on mutual responsiveness and scope clarity

• Changes in scope or delayed approvals may extend delivery timelines

6.2. Paused Projects

• Projects delayed more than 30 days due to lack of client communication may be paused

• A reactivation fee may apply to resume work after extended delays

  
  

7. Limitation of Liability

Martel Visuals is not liable for:

• Indirect, incidental, or consequential damages

• Loss of revenue or business outcomes related to site performance

• Technical issues caused by third-party platforms, tools, or services

• Results beyond our control after project handoff

Our maximum liability is limited to the total amount paid for the services provided.

8. Termination

Either party may terminate the engagement with written notice. Upon termination:

• Payment is due for all work completed to date

• Source files or work-in-progress may be shared at our discretion

• Confidentiality obligations remain in effect

  
  

9. Confidentiality

We respect and protect the confidentiality of client information and materials. Clients likewise agree not to disclose Martel Visuals’ internal processes, tools, or proprietary methods without written consent.

Changes to Terms

Martel Visuals may update these Terms of Service from time to time. Continued use of our services constitutes acceptance of the most current version.
